PORT ELIZABETH - 2 SENTENCED FOR 2016 MURDER, RAPE, HIJACKING & KIDNAPPING OF 2 NMU STUDENTS


The two accused arrested for the murder, rape, hijacking and kidnapping of two NMU students on 13 August 2016 was sentenced today, 23 May 2019 in the Port Elizabeth High Court.

On 13 August 2016 at about 21:30 the two students aged 21 and 28 were hijacked in North End in Port Elizabeth while seated in the car, four suspects approached the couple and pointed them with a firearm. The couple was pushed in the boot of the car and two suspects drove off with their vehicle.

The couple was taken to a beach in Port Elizabeth where the 21-year-old woman was raped and her male friend shot a few meters away from the car. The suspects drove off with the woman and dropped her off in central Port Elizabeth. The incident was reported to police during the early hours of the morning on 14 August 2016.

An investigation task team was immediately mobilised and on 22 August 2016, Thulani Jusaya (20) was arrested in Kwazakele. The second accused, Siyabulela Malgas (18) handed himself over to police on 26 August 2016. They remained in custody until the finalisation of the case.

On Thursday, 23 May 2019, both accused were sentenced as follows:

Thulani Jusaya:     Count 1 and Count 2 - Kidnapping                                                               8 years imprisonment

Count 3 and Count 4 – Robbery with aggravating circumstances
15 years imprisonment

Count 5 and Count 6 – Rape                                                                         life imprisonment

Count 7 and Count 8 –Possession of firearm and ammunition
8 years imprisonment

Count 9 - Assault GBH
10 years imprisonment

Count 10 –Murder                                                                     
life imprisonment

None of the sentences will run concurrent. Effectively he will serve two life sentences and 41 years imprisonment.

Siyabulela Malgas: Count 1 and 2 - Kidnapping                                                               8 years in prison

Count 3 and 4 – Robbery with aggravating circumstances
10 years in prison of which 5 years is suspended

Count 10 - Murder
10 years in prison of which 2 years is suspended for 5 years.

All sentences will run concurrent so effectively he will serve 8 years in prison.

During the investigation, two other suspects were arrested. One suspect died before being charged and the other was acquitted in March 2019.
